DMCA and Trademark Policy - VirtualWebPhone
Last updated: 2026
VirtualWebPhone respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and applicable trademark laws worldwide.
Trademark policy
VirtualWebPhone is an independent phone-number service provider. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any of the third-party services, brands, or trademarks that may be referenced on our site.
Where third-party trademarks appear in our content, they are used solely for descriptive purposes under the doctrine of nominative fair use. This use is limited to identifying compatibility between our phone-number service and the third-party service in question. Nominative fair use is a well-established legal doctrine in United States trademark law (see New Kids on the Block v. News America Publishing, 971 F.2d 302, 9th Cir. 1992) and equivalent principles apply in most other jurisdictions.

We review all complaints within 5 business days and respond in accordance with applicable law. Complaints that meet the criteria above will be actioned promptly.
Compliance actions we may take
- Removing or modifying content referencing your mark
- Adding stronger nominative-fair-use disclaimers
- Redirecting URLs to generic descriptive pages
- Blocking specific brand mentions site-wide
Counter-notice procedure
If content of yours is removed and you believe removal was in error (e.g., you have legitimate rights or the complaint was based on fair use), submit a counter-notice to [email protected] with the same information format above plus your legal defense.
Repeat infringer policy
VirtualWebPhone does not host user-generated content. Our service provides temporary US virtual phone numbers for SMS reception, monetized by advertising. No user account or upload capability exists. Repeat-infringer policy therefore applies primarily to any future comment or user-content feature that may be added.

Nominative fair use guidance for complainants
Before filing a trademark complaint against a descriptive use on our site, please review the nominative fair use three-part test:
- The service is not readily identifiable without the mark — we cannot describe compatibility with your service without naming it.
- Only as much of the mark is used as reasonably necessary — we use the plain word mark, not logos, colors, or trade dress.
- Nothing suggests sponsorship or endorsement — this policy and site-wide disclaimers make clear we are independent.
Complaints that ignore this framework and attempt to prevent legitimate nominative use will still be reviewed, but we reserve the right to defend fair use where warranted.
